General Terms and Conditions D’CONSTRUCTED AG
1. Scope of Application
These General Terms and Conditions ("Terms") apply to orders placed by the customer (hereinafter "the Customer") with D’CONSTRUCTED AG (hereinafter D’CONSTRUCTED) through the D’CONSTRUCTED online shop. By placing an order, the Customer confirms the General Terms and Conditions between themselves and D’CONSTRUCTED. When purchasing at D’CONSTRUCTED's stores, the Terms only become part of the contract if the Customer is given the opportunity on site to review the Terms and accepts them.
D’CONSTRUCTED reserves the right to amend these Terms from time to time without prior notice. The version of the Terms that applies to the Customer is the one to which they agreed when placing their order.
2. Conclusion of the Purchase Agreement
The presentation of products in the online shop does not constitute a legally binding offer, but merely a non-binding invitation to the Customer to order the product through the online shop. D’CONSTRUCTED expressly reserves the right to change content, images, the product range, prices, product descriptions, and the products themselves at any time and without prior notice. Illustrations, images, brochures, advertising, and other information about D’CONSTRUCTED's products are for informational purposes only and are not binding.
The Customer can place a binding order for the products they have selected through the D’CONSTRUCTED online shop. To do so, they can place the selected products in the "shopping cart." This does not yet constitute a binding order. An order is only considered binding once the Customer clicks the "Order with obligation to pay" button on the order page at the end of the checkout process. Before submitting the order, the Customer has the opportunity to view and change the details at any time, to identify any input errors, and to correct them before the order is finally and bindingly submitted. By submitting the order, the Customer confirms that they have read the Terms and agree to them without reservation. D’CONSTRUCTED recommends that the Customer print out or save on their computer the version of the Terms valid at the time the order is submitted, for the purpose of documenting the order.
The Customer immediately and automatically receives confirmation of the order placed by email (order confirmation). This confirmation email contains the details of the Customer's order and the General Terms and Conditions accepted during the ordering process. The confirmation email merely serves to inform the Customer that their order has been received by D’CONSTRUCTED. No purchase agreement is concluded by the automatic order confirmation.
After the Customer has placed a binding order, D’CONSTRUCTED is free, at its own discretion, to either accept the order, decline it by a corresponding notice via email, or submit a counter-offer to the Customer. Any payment already made will be refunded to the Customer if the order is cancelled. Reasons for declining an order may include, for example, that a product is no longer available, that D’CONSTRUCTED is unable to obtain authorization for the Customer's payment, or that there is reason to believe that the Customer may breach contractual obligations, engage in fraudulent or criminal conduct, or otherwise act in bad faith.
A binding purchase agreement with the Customer is concluded once D’CONSTRUCTED accepts the order. The order is accepted by way of the shipping confirmation sent by email. The Customer is no longer bound by their offer if they do not receive a shipping confirmation within 40 days of receiving the order confirmation.
3. Delivery and Pickup
D’CONSTRUCTED delivers throughout Switzerland and to Liechtenstein. Products are shipped directly to the address provided or to the branch requested by the customer. The customer receives a confirmation by email once the ordered product has been dispatched (shipping confirmation) and once it is ready for pickup at the branch (pickup confirmation). Delivery usually takes place within 4-5 weeks of order confirmation. This is an approximate guideline and does not create any entitlement to a specific delivery or pickup date.
D’CONSTRUCTED products are available while stocks last. Should D’CONSTRUCTED find, while processing an order, that a product ordered by the customer is not available, the customer will be informed immediately.
D’CONSTRUCTED reserves the right to limit the number of items offered. In this case, the customer will be informed of the limitation by email after placing the order.
4. Prices and Shipping Costs
Products and prices in the D‘CONSTRUCTED online shop are quoted in Swiss francs (CHF) and include statutory value-added tax (VAT). The total price of the customer's order, including all additional and shipping costs, is shown to the customer at the end of the checkout process. For deliveries within Switzerland, D’CONSTRUCTED covers the shipping costs for orders with a net merchandise value (i.e. the value after deduction of any discounts and excluding VAT, additional costs, shipping costs, etc.) of CHF 150.- or more per delivery.
D’CONSTRUCTED reserves the right to change prices at any time. The customer's offer is based on the prices shown at the end of the checkout process.
5. Payment Terms
The customer may pay using the payment methods listed in the online shop or displayed during the checkout process. The range of available payment methods may change from time to time. D‘CONSTRUCTED reserves the right to decline a payment method requested by the customer and to limit the selection of available payment methods (e.g. by restricting payment to prepayment only, to safeguard against credit risk).
By selecting a payment method and subsequently entering the corresponding credit card or other access details, the customer authorizes the payment. By placing the order, the customer confirms that they are authorized to use the payment method, that the payment method is valid, and that the payment details entered are correct.
6. Right of Return for Defects
It is the customer's responsibility to inspect the ordered product for any defects immediately upon receipt. Any defects found must be reported to D’CONSTRUCTED without delay, and the defective product must be returned immediately. Notification of any defects found must be made in writing, either by email to suits@dconstructed.com or by completing the enclosed return form. Defective products must be returned in their original packaging or dropped off at one of our stores. If the product's defectiveness is established and it is proven that the defect already existed prior to the transfer of risk, D’CONSTRUCTED will bear the costs of return shipment as well as of any re-shipment. In all other cases, the customer bears the costs of return and any re-shipment. Drop-off at one of our stores is always free of charge. If a product has a significant defect or is missing a warranted characteristic, D’CONSTRUCTED will take back the defective product. In this case, the customer will receive a defect-free product of the same type, provided such a replacement is not excluded due to the limited stock of the product concerned. If a replacement is not possible, any purchase price already paid will be refunded to the customer in full. In the case of a return, please use the following return address:

7. Masterpieces
For certain products, the customer has the option to order samples for try-on purposes. An order typically consists of three samples, which together form a "Masterpiece." The try-on is intended to give the customer a better sense of the product's size and features. The samples are provided to the customer solely for the purpose of trying them on and remain the property of D’CONSTRUCTED. Any use of the samples beyond mere try-on is not permitted. Prohibited uses include, in particular, wearing the samples outside one's own home, at events, during sports activities, or in the course of professional activity.
Ordering a Masterpiece for try-on is free of charge. The customer may use the Masterpiece for try-on, in the sense described above, for five days. The day of receipt is not counted. Complete return must take place on the fifth day, either by handing it in at a post office or by delivering it to one of D’CONSTRUCTED's stores.
If the customer misses the deadline for the complete return of a Masterpiece (default), D’CONSTRUCTED will place the customer in default by way of a reminder. If the return does not take place within the grace period set together with, or following, the reminder, D’CONSTRUCTED is entitled to charge the customer a flat-rate damages amount of CHF 50.- for each further reminder, to cover the expenses directly associated with the reminder (flat-rate damages). Where the damage cannot be proven, the flat-rate damages shall be deemed a contractual penalty.
If the customer also misses the extended grace period, D’CONSTRUCTED is entitled to waive the complete return of the Masterpiece and, without having to prove damage, to claim a contractual penalty of CHF 500.- per sample not returned in full (right of election). In this case, the samples not returned are deemed lost (loss). If the samples are returned within the deadline, or at least before the right of election is exercised, but one or more samples show defects (defectiveness), D’CONSTRUCTED is entitled, without having to prove damage, to claim a contractual penalty of CHF 300.- per defective sample. In both cases (loss and defectiveness), the customer expressly may not discharge their obligation to return the item in flawless condition merely by paying the penalty (no substitute performance through payment of the penalty). In both cases (loss and defectiveness), D’CONSTRUCTED is entitled to claim, in addition to and cumulatively with the respective contractual penalty, compensation for the damage resulting from the loss or defectiveness of the samples. The contractual penalty is not credited against the damages amount. In both cases (contractual penalty and damages), it is the customer's responsibility to discharge their liability by proving the absence of fault.
In all other respects, the remaining provisions of these Terms apply by analogy to the ordering of Masterpieces. In particular, the customer must inspect the ordered Masterpieces for any defects immediately upon receipt and notify D’CONSTRUCTED of any defects found without delay.
8. Online Shop Terms of Use
D‘CONSTRUCTED wants to offer users of its offerings and websites an optimal online experience. This requires that its online services function flawlessly. The customer agrees (i) not to publish, transmit, forward, upload, or support any communications or content that could harm D’CONSTRUCTED or negatively affect its reputation, products, or services; (ii) not to act, or use any means, in a way that could restrict, impair, or disrupt other users in their use of D’CONSTRUCTED's websites, or that could compromise the security of the website; (iii) not to use any machines, software, tools, agents, scripts, or other means or mechanisms (including spiders, bots, crawlers, avatars, or intelligent agents) to navigate through or search the website, or to copy content from the website. D’CONSTRUCTED reserves the right to immediately deny access to, and delete the account of, any user who violates this or any other provision of these Terms.
9. Intellectual Property Rights
The content presented by D’CONSTRUCTED is, in part, protected by intellectual property rights. The exercise of intellectual property rights such as trademark, design, and copyright is reserved to the respective rights holders. Without the express consent of the rights holders, the content presented may only be used for personal, non-commercial purposes. This also applies to the copying and storing of content.
10. Severability
Should any provision of these Terms be or become unlawful, invalid, or unenforceable for any reason, this shall not affect the validity of the remaining provisions. Unless otherwise agreed, the invalid provision shall be deemed replaced by a valid provision that comes as close as possible to the economic purpose the parties intended with the invalid provision. The same applies to any gaps in these Terms.
11. Jurisdiction and Applicable Law
For all disputes arising in connection with the contractual relationship between the customer and D’CONSTRUCTED AG, the courts at the registered office of D’CONSTRUCTED AG have jurisdiction. Mandatory statutory provisions remain reserved. The contractual relationship between the customer and D’CONSTRUCTED AG is governed by Swiss law.
